MovieDibs — Terms of Service

Welcome to MovieDibs. These Terms of Service ("Terms") are a binding agreement between you and Jason Jex, an individual sole proprietor operating MovieDibs ("MovieDibs," "we," "us," or "our"). They govern your use of the MovieDibs mobile app and website (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 13 years old to use MovieDibs. If you are under the age of majority in your state, you may use the Service only with the involvement of a parent or guardian. The Service is intended for users in the United States. By using it, you represent that you meet these requirements.

2. Your account

• MovieDibs accounts are created and secured through Google Sign-In. You're responsible for the Google account you use to sign in and for all activity under your MovieDibs account.
• Keep your account secure. Notify us promptly (see §17) if you believe your account has been accessed without your permission.
• You may have one account for your personal use. Don't impersonate others or misrepresent your identity, including in your username or display name.

3. The Service

MovieDibs helps you and your friends track what to watch — building watchlists, seeing streaming availability, and running group decision modes (voting, tournaments, pick-for-me). We may add, change, or remove features at any time. Some features are free; others may require a premium subscription (see §6).

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Harass, threaten, defame, or abuse other users through usernames, shared lists, recommendation notes, or any other content;
• Post or share content that is illegal, hateful, obscene, infringing, or that violates others' rights or privacy;
• Impersonate any person or entity, or misrepresent your affiliation;
• Attempt to access accounts, data, or systems you're not authorized to access, or probe, scan, or test the vulnerability of the Service;
• Interfere with or disrupt the Service, including by scraping, overloading, or circumventing rate limits, security, or access controls;
• Reverse engineer, decompile, or attempt to extract source code, except where that restriction is prohibited by law;
• Use the Service to build a competing product or to resell or redistribute our data.

We may investigate and take action — including removing content, suspending, or terminating accounts — for conduct that violates these Terms.

5. Your content

• You own the content you create in MovieDibs — your watchlists, usernames, notes, and similar contributions ("Your Content").
• You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and use Your Content solely to operate, provide, and improve the Service — including showing it to the friends and group participants you choose to share it with. This license ends when you delete the content or your account, except for content others have already saved or reasonable backup copies.
• You are responsible for Your Content and represent that you have the rights to share it and that it doesn't violate these Terms or any law.
• Certain features let you share content with other users (friend shares, recommendations, group sessions). When you share, you understand the people you share with can see that content.

6. Premium subscriptions and payments

• MovieDibs may offer a premium subscription with additional features. Pricing and features will be shown in the app before you purchase.
• Purchases are processed by the app store (Google Play or the Apple App Store), not by us. Your payment, billing, and (where applicable) auto-renewal are governed by that store's terms. We don't receive or store your payment card details.
• Subscriptions auto-renew unless you cancel through your app-store account before the renewal date. Manage or cancel subscriptions in your app-store account settings.
• Refunds are handled by the app store under its refund policies; we generally cannot issue refunds directly.

7. Ads

The MovieDibs mobile app may display advertising, including through Google AdMob. Your interaction with ads and advertisers is between you and them. See the Privacy Policy for how advertising data is handled. Premium users do not see ads.

8. Streaming availability and third-party content

• MovieDibs shows movie/show information and streaming availability sourced from third parties, including Watchmode. This information can be incomplete, out of date, or inaccurate, and availability changes frequently. We don't guarantee that a title is (or isn't) available on any service, in theaters, or at any price. Verify with the streaming service before relying on it.
• MovieDibs is not affiliated with, endorsed by, or sponsored by Netflix, Hulu, Disney+, Max, Amazon, or any other streaming service, studio, or content owner. All titles, artwork, logos, and trademarks belong to their respective owners.
• The Service does not provide streaming itself and does not access your streaming accounts.

9. Our intellectual property

The MovieDibs name, logo, app design, and original software are owned by us and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not use our branding without our permission. Third-party content (movie metadata, artwork) belongs to its owners.

10. Termination

• You can stop using the Service and delete your account at any time (Settings → Delete Account), which permanently removes your account and associated data as described in the Privacy Policy.
• We may suspend or terminate your access, with or without notice, if you violate these Terms, if we're required to by law, or if we discontinue the Service.
• Sections that by their nature should survive termination (e.g., §5 licenses already granted, §8, §11–§16) survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't warrant that the Service will be uninterrupted, secure, error-free, or that any availability information will be accurate or current. You use the Service at your own risk.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVIEDIBS AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR US $50. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless MovieDibs and its operator from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or any law or third-party right.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date and provide notice in the app or by other reasonable means. Your continued use of the Service after changes take effect means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws rules. You and MovieDibs agree that the state and federal courts located in Duval County, Florida will have exclusive jurisdiction over any dispute arising from these Terms or the Service, and you consent to venue there. These Terms do not require binding arbitration.

16. Miscellaneous

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability. If any provision is found unenforceable, the rest stays in effect.
• No waiver. Our failure to enforce a provision isn't a waiver of it.
• Assignment. You may not assign these Terms; we may assign them in connection with a business transfer.
